Terms and Conditions

Chapter 1. General Provisions

Article 1

The purpose of these Terms and Conditions is to set forth the rights, obligations and responsibilities of the parties using website based services provided by Payus.

Article 2 (Definition)

Terms used herein shall have the following meaning:
  • ① Member: a natural or juridical person who has provided personal information to be registered and received ID by signing the user agreement with the company
  • ② ID: a combination of letters and numbers chosen by a member, approved by and registered with the company, for purposes of identification and use of the services
  • ③ Password: a combination of letters and numbers chosen by a member, to protect the member’s information.
  • ④ Termination: a termination of the user agreement by the company or a member.

Article 3. Announcement and effect of Terms and Conditions & changes

Terms used herein shall have the following meaning:
  • ①These terms and conditions shall be published on the member registration page. The company may change the terms and conditions, if there is an important business reason; any changed conditions shall be notified through notice.
  • ②The changed conditions in accordance with the terms and conditions and the company’s needs, shall become effective by public notice to users.

Article 4. Other rules to comply with

Any other condition that is not specified herein, but is provided in the law, such as Telecommunications Act, the Telecommunications Business Act, the Information & communication promotion Act, the Protection of Consumers in e-commerce and Other Transactions Act and consumer protection act, one shall comply with such law.
Chapter 2. User Agreement

Article 1. Application for the use of service

  • ①In the membership registration guide, the applicant agrees to these terms and conditions and the privacy policy, goes through the registration process (fill out the registration form in the Company's prescribed form) and press the 'Confirm' button to apply for use.
  • ①Applicants for use must use their real name and actual information and can apply for one use per date of birth.
  • ③Users who do not enter their real name or actual information are not legally protected and may be restricted from using the service.

Article 2. Approval of an application

  • ① The company shall grant the service use exception to those who apply for use under Chapter 2 Article 1, except the case of section 2 and section 3.
  • ② The company may defer its acceptance until its reasons for limitation are removed, provided that:
    a. In case service related facilities are not available
    b. In case technical issues arise
    c. In case when the company recognizes the need
  • ③ The company may not accept, provided that:
    a. in case an applicant used another person’s name
    b. in case an applicant used false information
    c. In case of application for the purpose of undermining the peace order and public moral of society
    d. In case an applicant does not meet the requirements set by the company
Chapter 3. Obligations of the parties

Article 1. Obligations of the company

  • ①The company is responsible for stable and continuous operation of the website.
  • ② The company shall be responsible for the compensation to user if it recognized user’s claim is reasonable. However, if it is difficult to handle the problem immediately, the user shall be notified by notification or e-mail of the reason for such delay and follow up schedule.
  • ③The cases of investigation requests from related agencies and the Information and Communication Ethics Committee, presentation of warrant or application of other law are exception for section 1.

Article 2. Obligations of User

  • ① The users shall fully understand the terms and conditions, company notices, and information about the use of the site, and shall not perform any acts that interfere with the business of the company.
  • ② The user may not engage in any commercial activity using this website without prior approval from the company.
  • ③ The users shall not copy, replicate, alter, translate, publish, broadcast and other means to provide information obtained through the website to others without prior consent from the company.
Chapter 4. Provision and use of service

Article 1. Use of service

  • ① A user shall use the website in accordance with the provisions of the T&C.
  • ② Matters concerning of service use not specified in the T&C shall follow rules that are posted on the ‘notice’ of the company or otherwise notified separately.

Article 2. provision of information

The company may provide various information recognized as necessary during service use to the members via e-mail or a letter.

Article 3. Advertisement

  • ① The company may post advertisements on the service page, homepage and e-mail in connection with the operation of the service.
  • ②The company shall not be held liable for any loss or damages caused by members any actio n (participation, correspondence or transaction) in the promotional activities, which advertisers posted on the website.

Article 4. Restriction on use of the services

The company may restrict the use of the website if a user’s use and acts fall under the following cases:
  • ① In case the public order and other social order is harmed
  • ② In case a user is dully recognized as being involved in a criminal act or in relation to another criminal act
  • ③ In case a user significantly impairs and damages the reputation of another
  • ④ In case of continuous transmission of content against the will of others or advertisement
  • ⑤ In case a user interrupts the service by hacking or spreading viruses
  • ⑥ In case a user infringes on other people’s rights including trademark rights and design rights
  • ⑦ In case a user steals and uses another person’s ID and password
  • ⑧ In case a user violates relevant laws and the company considers that the user is unfit

Article 5. Suspension of provision of the services

The Company may suspend its provision of the services partially or entirely upon the occurrence of events listed below:
  • ① If the service has been suspended by key telecommunications service provider or Internet network service provider who are specified by the Telecommunications Business Act
  • ② If power failure prevents service
  • ③ In case of an unavoidable case of relocation, repair or construction of a facility
  • ④In case normal service provision is difficult due to failure of service facilities or excessive use of services
  • ⑤ In case of war, accident, natural disasters or any other national emergency

Article 6. management of posts

The company may randomly delete or register the data posted by users, which is considered to be under chapter 4, article 4, in order to establish a sound communication culture and to operate the site efficiently.

Article 7. Service use and responsibility

The users shall not make any commercial activities such as illegal commercial activities – especially, hacking, money-making advertisement, commercial activities via harmful site and illegal distribution of commercial S/W - by using the service unless specifically permitted in written consent of an authorized employee. The company shall not be held liable for any legal action including the consequences and losses of such activities and the arrest by the relevant agency.
Chapter 5. Order and Payment

Article 1. Payment method

‘Member’ may pay for goods and services sold by the ‘company’ with ‘various card payment methods including debit card and credit card’.

Article 2. Cancellation and refund policy

In the event that the product or service which a user applied for purchase may not be provided or delivered due, the Company shall notify the situation to the user without any delay, and in the event that it has received the payment for the product or service in advance, it shall refund the payment or take necessary measures within 3 business days from the date of receipt of the payment.
  • ① If a user cancels the payment before goods and services are provided, the Company cancels the order and the credit card payment approval.
  • ② It is not allowed to cancel payment after goods and services are provided. However, if the Company is careless and causes service problems, the Company shall take measures, enabling a user to return the purchased amount and get refund.
Chapter 6. Miscellaneous

Article 1. Exemption and indemnification

  • ①The Company shall be exempted from the responsibility for providing the service if it cannot be provided due to natural disasters or a force majeure event equivalent thereto.
  • ②The company shall not be held liable for any consequences arising out of the transactions between users or between users and third parties.
  • ③The company shall not assume any responsibility for the accuracy or reliability of facts in relation to the information, data, and contents posted on the bulletin board by users; users shall use the website under their own responsibility.
  • ④ The user shall be responsible for any damage arises related to all data posted or transmitted by a user, and for any disadvantage arises by choosing data and/or free service.
  • ⑤The user shall be responsible for the management of the ID and password; the user takes responsibility for damages caused by negligence of the user or unfair use by third parties.
  • ⑥In the event a user violates the provisions of this Agreement, the user shall indemnify the company from any damages incurred.

Article 2. Agreement for provision and use of personal credit information

Personal credit information obtained by the company though the registration needs user’s consent in the provision and utilization of the credit information to others, in accordance with Article 23 of the Act on the Utilization and Protection of Credit Information. The consent of the user shall be used as data for determining the credit of the users by providing the credit information to the credit information institutions, credit information companies, and other users.

Article 3. Settlement of dispute

  • ①The company and the users shall put all necessary efforts to settle disputes arising in the use of the website.
  • ② Notwithstanding section 1, if a lawsuit is filed due to such disputes, the lawsuit shall be regarded as the jurisdiction of the court governing the location of the company's headquarters.
